Adpotion Information Disclosure Process

Eligibility for petition

  • · Legal basis: Article 36 of the Special Adoption Act (Disclosure of adoption information, etc.)
  • · Adoptee
    Adult: An adoptee may petition for disclosure of information
    Minor: An adoptee may petition for disclosure of information with the consent of an adoptive parent
    ※ Definition of an adult: 19 years old

  • · Petitioner: Adoptee
  • · Institution to be petitioned: Korea Adoption Services or an adoption agency (adoption record holding institution)
Deciding on an institution to handle disclosure of information
  • · Korea Adoption Services: May directly petition the Korea Adoption Services
    ※If necessary, adoption document reinterpretation service is available
  • · Adoption agency: May directly petition a relevant agency
    ※If another adoption agency is petitioned, the petition shall be transferred to the Korea Adoption Services or a relevant adoption agency and the petitioner shall be notified of such transfer
Locating a birth parent
  • · An adoption agency requests the Korea Adoption Services to locate the birth parent
    ※ Work flow: Adoption agency → Korea Adoption Services → Related institution → Korean Adoption Services → Adoption agency
Verifying consent to information disclosure
  • · After verifying the whereabouts of birth parents,verify their consent to information disclosure
Disclosing adoption information
  • · If birth parents consent: Disclose all information
  • · If birth parents do not consent: Disclose information excluding personal information on birth parents
    ※If an adoptee has a special reason such as a medical purpose, the information may be disclosed regardless of consent of birth parents

Step 1Fill out the for Petition for Adoption Information Disclosure

  • · Required documents: Petition for Adoption Information Disclosure form,identification document
    (resident registration card,passport,foreign registration card,or other certificate(s) confirming the petitioner's identity)
  • · If an adoptee is a minor:A letter of consent by an adoptive parent to petition for adoption information

  • 1) If an adoptee desires to check his/her adoption information
    (excluding personal information on birth parents at the time of adoption)
    The adoptee may check the details of his/her adoption documents.
    The document may be perused and copies maybe provided

    Tip)

    In the Petition for Adoption Information Disclosure form,check items excluding
    "Personal Information on Birth Parents."

  • 2) If an adoptee desires to check personal information on birth parents at the time of adoption and make contact and/or conduct a reunion
    The Korea Adoption Services or an adoption agency verifies the birth parents' consent to disclosure of adoption information. (Personal information on birth parents will be disclosed only if the information is verified.However,the birth parents may refuse to disclose their personal information.)

    Tip)

    In the Petition for Adoption Information Disclosure form,check items excluding
    "Personal Information on Birth Parents."

Step 2Submit the form for the Petition for Adoption Information Disclosure

  • 1) Request to the Korea Adoption Services

    • · A petition may be submitted to request the disclosure of adoption information via the Korea Adoption Services.
    • · If necessary, adoption document reinterpretation service is available.
  • 2) Request to an adoption agency

    • · A petition may be submitted to request the disclosure of adoption information via an adoption agency.

    Petitioning the Korea Adoption Services or an adoption agency in Korea for disclosure of adoption information does not require the payment of any service fee.

  • 3) Petition method

    • · A petitioner may submit the form by visiting the Korea Adoption Services or an adoption agency in person,or via post,fax or e-mail.
  • 4) Petition details

    • · Legal basis: Article 13 of the Enforcement Decree of the Special Adoption Act (Adoption information subject to petition for disclosure)
    • · Personal information on birth parents(at the time of adoption):Name,date of birth,address,and contact number
    • · Adoption background: Age of birth parents at the time of adoption, date of adoption and reasons for adoption, name of the domicile area of birth parents (name of a si/gun/gu)
    • · Name, resident registration number, date of birth, and place of birth of the petitioner prior to the adoption
    • · Name, address, and contact number of the protective facility or adoption agency where the petitioner was taken into care prior to the adoption

Step 3Progress is updated by Korea Adoption Services or an adoption agency.

  • 1) Verify the whereabouts of the birth parents

  • 1) Verify the whereabouts of the birth parents

    A petitioner may check the decision on the disclosure of adoption information from the Korea Adoption Services or anadoption agency within 15 days from when such a request is made.
    However, if there are circumstances preventing disclosure of adoption information, such as unknown whereabouts of birth parents, the notification period may beextended for up to 30 days and the extension and its reasons therefor shall be notified to the petitioner.
